MYRAKELL Privacy Policy

MYRAKELL LLC ("MYRAKELL," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, store, and otherwise process information when you access or use the MYRAKELL website, software platform, applications, dashboards, Business Workspaces, reports, artificial intelligence features, communications tools, and related services (collectively, the "Service").

This Privacy Policy applies to information processed through MYRAKELL.com and the MYRAKELL Service. By using the Service, you acknowledge the practices described in this Privacy Policy.

1. About MYRAKELL

MYRAKELL is a software platform designed to provide business intelligence, prospect discovery, business research, website analysis, artificial intelligence-assisted analysis, reports, proposals, customer relationship management tools, Business Workspaces, and related functionality.

MYRAKELL may be used by agencies, marketers, consultants, sales professionals, businesses, Business Owners, Agency team members, and other authorized professional users.

MYRAKELL operates as a software platform. MYRAKELL does not provide custom software development services and does not develop software applications for users or their clients. Unless expressly stated otherwise, MYRAKELL also does not perform digital marketing, advertising, sales, or consulting services on behalf of users.

2. Information We Collect

The information MYRAKELL collects depends on how you interact with the Service. We may collect the categories described below.

2.A Account and Identity Information

When you register, accept an invitation, request access, maintain an account, or interact with the Service, we may collect name, display name, email address, telephone number, password hash, job title, department, time zone, profile information, email signature, Agency or Workspace role, account status, plan status, Agency membership, verification information, password-reset information, account creation/modification/deletion information, failed-login counts, and account-lockout information.

2.B Agency Information

If you create, administer, work for, or otherwise interact with an Agency through MYRAKELL, we may collect Agency name, legal business name, business description, mission statement, website, telephone number, email and support contact information, physical business address, location information, social-media and Google Business URLs, time zone, currency, language and formatting preferences, logos and branding assets, colors and fonts, favicons, backgrounds and watermarks, PDF and email assets, custom-domain information, feature settings, plan or trial information, account limits, administrative notes, and Agency privacy and terms URLs.

Agency administrators may also configure email-delivery information, including SMTP or other email-provider configuration.

2.C Business and Prospect Information

MYRAKELL processes information about businesses and prospective customers. This may include business name, industry, city and state, business address, telephone number, website, third-party place identifiers, ratings, review counts, website status, website title, meta description, page headings, structured-data indicators, technology indicators, website security and technical signals, pipeline status, follow-up information, assignments, Agency association, Business Owner relationship, analysis results, recommendations, opportunity scores, revenue-opportunity estimates, and related historical information.

Some business information may constitute personal information when it relates to an identifiable individual, such as a sole proprietor or individual business representative.

2.D CRM and User-Provided Content

Users may enter or create notes, pipeline notes, calls, meetings, tasks, emails, message subjects and bodies, CRM activities, notifications, email templates, proposals, instructions, customer information, and other free-text information. Users should only provide personal information they are authorized to provide.

2.E Uploaded Files

Authorized users may upload files associated with businesses or other Service functions. Information associated with uploads may include original and stored filenames, file type, MIME type, file size, uploading user, associated business, upload date, and file contents. MYRAKELL may also store Agency branding and communication assets.

3. Information Obtained from Third-Party and Public Sources

MYRAKELL may obtain information from third-party services and publicly accessible sources.

Google Places or similar business-information services may provide place identifiers, business names, formatted addresses, ratings, review counts, websites, telephone numbers, and other business/place information.

MYRAKELL may retrieve publicly accessible business websites and analyze selected technical and content information, including website availability, final URL, HTTPS status, page title, meta description, page headings, structured-data indicators, technology indicators, and similar publicly accessible characteristics.

4. Artificial Intelligence Processing

MYRAKELL uses third-party artificial intelligence services, including Google Gemini, to support certain Platform features such as business analysis, recommendations, proposal generation, and outreach-content generation.

4.1 Information Processed by AI Services

MYRAKELL limits information submitted through its AI workflows to business and market-analysis information reasonably necessary to provide the applicable Platform functionality.

MYRAKELL's current AI processing controls are designed to exclude personal contact information, CRM notes and messages, uploaded files, raw website content, account credentials, and raw third-party API payloads from prompts submitted to Google Gemini.

Information that may be processed can include business name, general business location such as city, industry or business category, business-performance indicators, ratings and review information, derived scores, identified business issues, recommended services or actions, competitive or market information, and estimated business opportunities.

4.2 Third-Party AI Processing

Information submitted to third-party artificial intelligence providers is processed subject to the provider's applicable terms, privacy practices, data-processing arrangements, security requirements, and legally required retention practices.

MYRAKELL currently uses the paid Gemini API service for its Google Gemini processing. Under Google's applicable terms for paid Gemini API services, Google states that prompts and generated responses are not used to improve Google's products. Google may retain certain prompts, contextual information, and generated outputs for a limited period for abuse prevention, security, and legal or regulatory purposes.

4.3 AI-Generated Content

AI-generated results may be stored by MYRAKELL when necessary to provide Platform functionality, maintain applicable business records, or allow authorized users to review, edit, and use generated content.

Artificial intelligence systems may produce incomplete, inaccurate, outdated, or otherwise unsuitable information. Users are responsible for reviewing AI-generated analysis, recommendations, proposals, outreach content, and other generated material before relying upon, publishing, sending, or otherwise using it.

MYRAKELL does not represent AI-generated content as professional legal, financial, medical, accounting, or other regulated professional advice.

5. Automatically Collected Information

When you access or use MYRAKELL, we may automatically receive or generate technical and security information, including IP address, user-agent string, browser type, operating system, login date and time, login status, account activity, session information, device information, security events, and audit information.

MYRAKELL uses this information for authentication, security, troubleshooting, account administration, fraud prevention, audit trails, and operation of the Service.

6. Cookies and Similar Technologies

MYRAKELL currently uses cookies necessary to operate the Service, including a signed session cookie for authentication and account-session functionality.

The current application does not use browser localStorage or sessionStorage for application data, and no analytics or advertising-cookie implementation was identified in the current application review.

Additional information is provided in our Cookie Policy. If MYRAKELL introduces analytics, advertising, session-replay, or other optional tracking technologies in the future, this Privacy Policy and applicable consent mechanisms will be updated as appropriate.

7. How We Use Information

MYRAKELL may use information to provide and operate the Service; create and administer accounts; authenticate users; verify invitations and access; maintain Agency teams and roles; provide Business Workspaces; discover and analyze businesses; generate AI-assisted analysis and recommendations; produce reports and proposals; assist with communications; maintain CRM functionality; provide customer support; send transactional and Service-related emails; administer Beta access; personalize platform configuration; maintain Agency branding; maintain security; detect unauthorized access; prevent fraud and abuse; troubleshoot technical problems; maintain audit records; monitor Service reliability; improve functionality; enforce our Terms of Service; protect MYRAKELL, our users, and third parties; comply with legal obligations; and establish, exercise, or defend legal claims.

8. Email and Communications

MYRAKELL may send transactional and Service-related communications. Information processed for email delivery may include recipient email address and name, sender and reply-to information, subject, HTML and plain-text content, invitation information, business name, city, industry, Agency contact information, Agency email signature, AI-generated outreach content, and opportunity estimates where applicable.

Email providers receive information as necessary to transmit messages requested or generated through the Service. Marketing communications, if introduced, may be subject to separate consent and opt-out mechanisms.

9. How We Disclose Information

We may disclose information to service providers that help operate MYRAKELL, including providers of hosting and infrastructure, databases, background processing, artificial intelligence, business-information APIs, email delivery, content delivery, security, technical support, and other operational services.

Information may be available to authorized users within the Agency or Workspace to which the information belongs. Agency administrators may have broader access to information associated with their Agency.

We may disclose information if reasonably necessary to comply with applicable law or legal process; enforce agreements; investigate fraud or abuse; protect the security of the Service; protect MYRAKELL's rights or property; protect users or third parties; or address emergencies involving potential harm.

If MYRAKELL is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be transferred or disclosed as part of that transaction, subject to applicable law.

10. Sale and Sharing of Personal Information

MYRAKELL does not currently sell personal information for monetary consideration.

MYRAKELL also does not currently use personal information for cross-context behavioral advertising, and the current application review identified no advertising-pixel or behavioral-advertising implementation.

If our practices change in a way that triggers applicable opt-out rights, we will update this Privacy Policy and provide mechanisms required by applicable law.

11. Business Data Versus Personal Information

MYRAKELL processes substantial information about businesses. Information about a corporation or other business entity may not always constitute personal information. However, business information may become personal information when it identifies or can reasonably be associated with an individual, such as a sole proprietor, individual Business Owner, Agency employee, individual professional, identifiable business representative, or a person's direct business contact information.

Where applicable privacy law treats such information as personal information, MYRAKELL will handle it accordingly.

12. Agency and Customer Responsibilities

Agencies and other organizations using MYRAKELL may independently determine what information they enter into the Service and how they use it. Depending upon the circumstances, an Agency or other customer may have independent obligations regarding information it collects from or about its customers, prospects, employees, contractors, or other individuals.

Agencies are responsible for their own privacy notices, customer permissions, lawful basis for processing where required, marketing and communications practices, compliance with applicable privacy laws, and handling of information outside MYRAKELL. MYRAKELL's Privacy Policy does not replace an Agency's own privacy obligations.

13. Data Retention

MYRAKELL retains information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Service; maintain accounts; preserve legitimate Business Workspace history; maintain reports and analyses; support Agency/customer relationships; maintain security records; prevent fraud; maintain audit trails; resolve disputes; enforce agreements; comply with legal obligations; and establish, exercise, or defend legal claims.

Different categories of information may be retained for different periods. MYRAKELL may use a soft-deletion model for certain accounts and business records rather than immediately physically deleting every associated record.

14. Account Deletion and Business Workspace History

Deleting or retiring an individual account does not necessarily delete all information associated with the Business or Agency.

When a Business Owner account is retired, MYRAKELL may mark the account deleted, archive the former account email for reuse handling, release ownership or access, retain the Business record, retain the Business Workspace, and retain legitimate historical information. This can permit another authorized Business Owner to access an existing Business Workspace without destroying the Business's historical record.

Where appropriate, personal information belonging solely to the former user may be deleted, anonymized, restricted, or retained according to applicable law and legitimate retention requirements.

15. Your Privacy Choices

Depending upon your relationship with MYRAKELL and applicable law, you may request that we provide information about personal information associated with you; provide access to certain personal information; correct inaccurate personal information; delete certain personal information; or address questions or concerns regarding our processing.

MYRAKELL does not currently provide a comprehensive automated self-service privacy-request portal or complete user-facing data-export function. Privacy requests may currently be submitted to ben@myrakell.com.

Please include enough information for us to understand your request. We may need to verify your identity and authority before fulfilling a request. We may deny or limit requests where permitted or required by applicable law.

16. California Privacy Rights

California residents may have privacy rights under California law depending upon the circumstances and whether a particular law applies to MYRAKELL and the relevant processing activity.

Where the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies, rights may include the right to know categories of personal information collected, sources, purposes and disclosure categories; request access to certain personal information; request deletion subject to exceptions; request correction; opt out of sale or sharing where applicable; limit certain uses of sensitive personal information where applicable; and receive non-discriminatory treatment for exercising applicable privacy rights.

Nothing in this Privacy Policy is intended to represent that MYRAKELL is subject to a particular privacy statute when the statutory requirements for applicability are not satisfied. MYRAKELL may voluntarily honor reasonable privacy requests even where a particular statutory right does not technically apply.

17. California Notice at Collection

This Privacy Policy describes the categories of personal information MYRAKELL currently collects and the purposes for which those categories are used. Principal categories include identifiers and contact information; account information; professional and business information; internet and technical activity; security and login information; user-created content; communications; uploaded files; Business Workspace information; and inferences, scores, recommendations, or analyses generated through the Service.

We use these categories for the purposes described in Section 7, How We Use Information. MYRAKELL does not currently sell these categories of personal information or share them for cross-context behavioral advertising.

Where applicable, MYRAKELL may provide shorter contextual notices at registration, Request Demo forms, or other points of collection that link to this Privacy Policy.

18. California Do Not Track Disclosure

Some browsers provide a "Do Not Track" ("DNT") signal. The current MYRAKELL application does not use advertising or behavioral-tracking technologies that alter their operation based on browser DNT signals. Accordingly, MYRAKELL does not currently respond differently to legacy browser DNT signals.

MYRAKELL does not currently permit third-party advertising networks to collect personal information through the Service for cross-context behavioral advertising. If MYRAKELL later introduces technologies requiring different treatment of recognized privacy-preference signals, this disclosure will be updated.

19. Security

MYRAKELL uses administrative, technical, and organizational measures intended to protect information. Current application controls include measures such as password hashing, login rate limiting, failed-login tracking, account lockout, session expiration, role and capability controls, Agency/tenant isolation controls, cross-Agency access restrictions, login records, audit records, and certain HTTP security headers.

No method of transmitting or storing information is completely secure, and MYRAKELL cannot guarantee absolute security. We continue to review and improve security controls as the Service develops. Users are responsible for maintaining the confidentiality of their credentials and notifying us promptly if they suspect unauthorized account access.

20. Third-Party Websites and Services

MYRAKELL may contain links to third-party websites or use third-party services. This Privacy Policy does not govern independent privacy practices of third parties. We encourage users to review applicable third-party privacy policies before providing information directly to those parties.

21. International Processing

MYRAKELL is operated from the United States. If you access the Service from another country, information may be processed or stored in the United States or other locations where our service providers operate. Privacy and data-protection laws in those locations may differ from laws in your jurisdiction. Where required by applicable law, MYRAKELL will use appropriate mechanisms for international transfers.

22. Children's Privacy

MYRAKELL is intended for business and professional users and is not directed to children. You must be at least 18 years old to create or use a MYRAKELL account.

We do not knowingly solicit personal information directly from children under 13 through the Service. If we learn that personal information from a child has been collected contrary to applicable law, we will take reasonable steps to address it.

23. Changes to This Privacy Policy

MYRAKELL may update this Privacy Policy from time to time to reflect changes to the Service, new functionality, new service providers, changes in data practices, changes in legal requirements, or other operational developments. The "Last Updated" date at the beginning of this Policy identifies the current version.

If we make material changes, we may provide additional notice through the Service, by email, or through another reasonable method where appropriate or required by law.
